Minnesota Life eService Center Terms

This eService Center permits you to access your personal contract data by product. By accepting and using the eService Center, you agree that these Terms and Conditions supplement any current agreements or understandings governing your contracts with Minnesota Life Insurance Company ("Minnesota Life"). Nothing herein affects your obligations to comply with all legal requirements from whatever source.

You represent on a continuing basis that you are authorized to have access to any contract ("Contracts") for which you have requested a User ID and Password. Because of the importance of safeguarding information about your Contract(s), you have also agreed to safeguard your User ID and Password and not provide them to others. You agree that Minnesota Life shall not be responsible for damages or loss resulting from any breach of security caused by your failure to maintain the confidentiality of your User ID or Password. Unauthorized individuals attempting to access this Site, or unauthorized use of any of the content of the Site, may be subject to prosecution. All Contract data is provided as a convenience and for your information, and is not the official record of your Contract activity. Your regular Contract statement(s) remain(s) the official record.

1. In general

This Site contains information about insurance and annuity contracts written by Minnesota Life which may be considered personal, confidential and private. This Site also contains general information about Minnesota Life's products and services. The materials available through this Site do not constitute an offer of any Minnesota Life product in any jurisdiction. Minnesota Life products are offered only by Minnesota Life's authorized financial professionals. Minnesota Life products are generally unavailable outside of the United States and not all products are available in all states.

2. Copyright/trademarks

The trademarks, logos and service marks ("Marks") displayed on the Site are the property of Minnesota Life and other parties. Users are prohibited from using any Marks without the prior written permission of Minnesota Life or such third party that may own the Marks. All content on the Site is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or suing any content on the Site for commercial, for-profit or public purposes.

3. No warranties

ALL INFORMATION ON THE SITE IS PROVIDED TO THE USER "AS IS" WITHOUT WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY OR ACCURACY. The information contained on the Site is provided for general informational purposes and as a convenience to the customers of Minnesota Life. Other than as required by consumer protection law, under no circumstance will Minnesota Life be liable for any loss or damage caused by a user's reliance on information obtained through the Site. Minnesota Life is not engaged in rendering any legal or professional services by placing the information on this Site. It is the responsibility of the user to evaluate the accuracy, completeness or usefulness of any information or other content available through the Site. Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific information or other content.

4. Limitation of liability

Minnesota Life specifically disclaims any liability (whether based in contract, tort, strict liability or otherwise) for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with access to or use of the Site (even if Minnesota Life has been advised of the possibility of such damages), including liability associated with any viruses which may infect a user's computer equipment.

5. Confidentiality of user communications

Except as required by law, Minnesota Life will make reasonable efforts to maintain the confidentiality of all user communications which contain personal user information and which are transmitted directly to Minnesota Life. You are responsible for maintaining the confidentiality and use of your password(s) and other security data. We are not liable if your passwords or other information is intercepted. We may rely on any instructions or transactions using these passwords or security data until notified otherwise by you.

6. Linked internet sites

Any links provided to other server sites are offered as a matter of convenience and in no way are meant to imply that Minnesota Life endorses, sponsors, promotes or is affiliated with the owners or participants in those sites, or endorses any information contained on those sites unless otherwise expressly stated. Minnesota Life is not responsible for the content available on any other Internet sites linked to the Site. Access to any other Internet sites linked to the Site is at the user's own risk.

7. Changes to rules and regulations

Minnesota Life reserves the right to revise these Provisions at any time and users are deemed to be apprised of and bound by any changes to these Provisions.

8. Violations of provisions

Minnesota Life reserves the right to seek all remedies available at law and in equity for a violation of any of these Provisions, including but not limited to the right to block access from a particular Internet address to the Site. This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota. If any provision of this Agreement shall be found unlawful, void or unenforceable, then that provision shall be severable and shall not affect the validity and enforceability of the remaining provisions.
